Terms of Use – Users of the Digital Test Center Platform

Preamble

The Digital Test Center platform (hereinafter "the Platform"), published by (Nineteen)², is a SaaS service designed for managing events and product testing.
Access to the Platform is granted to users designated by clients (brands, distributors, agencies, event organizers, public authorities).
These Terms of Use govern the use of the Platform by Users.
Acceptance of these Terms is mandatory for any access to and use of the Platform.

Definitions

  • User: any natural person with an individual account to access the Platform, designated or authorized by a Client.
  • Client: the company, brand, or organization that has subscribed to the Platform’s usage rights.
  • Platform: the Digital Test Center software solution provided in SaaS mode by (Nineteen)².
  • Personal Data: any information relating to an identified or identifiable natural person, collected, processed, or accessible via the Platform.

Access and Security

  • Each User is provided with personal and confidential login credentials.
  • Sharing credentials is strictly prohibited.
  • The User is responsible for keeping their credentials confidential and must take all reasonable security measures (strong password, no sharing with third parties, session locking).
  • Any action carried out through an account is deemed to be performed by the corresponding User.
  • In case of compromise or suspected unauthorized access, the User must immediately notify the Client and the Platform provider.

Use of the Platform

  • The User agrees to use the Platform only in accordance with its intended purpose and the instructions provided by the Client.
  • In particular, the User must not:
    • bypass or attempt to bypass technical security measures,
    • upload or transmit unlawful, malicious, or third-party infringing content,
    • use the Platform for purposes other than those defined by the Client.
  • The User acknowledges that any non-compliant use may result in suspension or termination of access without prior notice.

Personal Data and Confidentiality

  • The User may have access to Personal Data concerning participants, testers, or other individuals related to events managed on the Platform.
  • The User undertakes to respect the confidentiality of such data and to use it strictly within the scope of their assignment for the Client.
  • Any extraction, copying, or reuse of data outside the authorized scope is strictly prohibited.
  • The User must comply with applicable laws and regulations, in particular the GDPR when operating within the European Union.

Intellectual Property

  • All intellectual property rights related to the Platform (software, interfaces, databases, documentation) are the exclusive property of (Nineteen)².
  • The User shall not reproduce, modify, adapt, translate, decompile, or attempt to access the source code of the Platform.

Responsibilities

  • The User is solely responsible for their use of the Platform.
  • In the event of a breach of these Terms, access may be suspended or terminated, without prejudice to actions that may be taken by the Client or (Nineteen)².
  • (Nineteen)² cannot be held liable for the consequences of misuse of the Platform by the User.

Term and Termination

  • These Terms apply for the entire duration of the User’s access to the Platform.
  • Access may be revoked at any time by the Client or by (Nineteen)² in case of a breach of the Terms or termination of the contractual relationship with the Client.

Amendments

  • (Nineteen)² reserves the right to amend these Terms at any time.
  • Any material changes will be communicated to Users via the Platform.
  • Continued use of the Platform after notification of the new Terms shall constitute acceptance thereof.

Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall fall under the exclusive jurisdiction of the courts of Grenoble.
