DISCLAIMER OF LIABILITY AND TERMS AND CONDITIONS
The Portes du Soleil Territoire d'Evénements Association isorganising the Pass'Portes du Soleil MTB and its Mountain Bike Show, an event offering tests of mountain bikes, electrically assisted mountain bikes and scooters for the general public. Through the exhibiting brands, this "event" allows the general public to test equipment for 3 days in Châtel for those holding a test card worth €10 for 1 day / €15 for 2 or 3 days. This equipment is made available for test purposes only and should not be considered as a free rentalopportunity. The sale of equipment is forbidden except in exceptional circumstances. The tester undertakes to use the test equipment for no more than one hour. With the (digital) signature of this declaration, the test participant accepts and declares to be in agreement with the following points:
I. The equipment test will take place under his/her ownresponsibility. Namely, the tester disclaims the brand'sliability in the event of a fall (except in the case of a hiddendefect), and agrees that he/she is responsible for the equipmentin the event of theft during the "paged and effective" test. He also undertakes to take care of the equipment and not to damage it. A scratch on the equipment can happen, but in the case of a bent wheel, for example, the tester undertakes to paythe brand for repairs. In all cases, it's up to the tester and the brand to reach an agreement. When the equipment is returned, the brand is entitled to claim compensation if it considers thatthe product has been deliberately mishandled.
II. Mountain biking/scooter riding involves risks to the body, to health and to one's own life, so it is important to ride consciously. The test rider undertakes to provide information on the settings of the equipment. They must have their ownpedals and know how to use the equipment they are borrowing.
III. Wearing a helmet reduces the risk of dangerous injuries in the event of a fall and even if it does not protect against all risks (especially against various injuries to the head, neck or spine), it is compulsory to wear a helmet during the event.
IV. Taking part in a mountain bike lesson will reduce the riskof injury, so don't hesitate to get some supervision if you'renot at the right level.
V. The equipment (mountain bikes, ATVs, scooters, etc.) has been adapted to the participant's own physical and ridingcharacteristics according to the information provided by the participant.
VI. The participant undertakes to respect the rules of conducton the trails and paths.
VII. The participant undertakes to adapt his/her riding style to his/her abilities and know-how, and to exercise caution.
VIII. He must not drink alcohol or other intoxicatingsubstances, or take narcotics before and during the test. This iscommon sense, but it is important to remember it. The Pass'Portes du Soleil MTB has no duty of organisation or control, especially if the participants have the skills and knowledge referred to in point VI.
IX. If the data provided by the participant corresponds to point V, the Pass'Portes du Soleil MTB accepts no responsibility for the good condition and suitability/adaptability of the equipment made available to the test participant. The participant must check the equipment by his/her own meansbefore using it and check for any defects. The test participant is aware that the equipment is the property of the variousbrands present at the Pass'Portes du Soleil MTB Show and that he/she must handle it with care and return it at a later date in good condition and undamaged. The test participant must compensate the brand concerned for any damage to the equipment returned. In the event of total destruction, loss, theft, etc. of the equipment, the test participant undertakes to pay compensation up to the replacement market value. Awareof these circumstances, the test participant waives before the aforementioned brand, the Pass'Portes du Soleil MTB and itscollaborators, representatives, organisations or otherauthorised persons any claim or demand of any kind, especially those concerning a right to compensation arisingfrom participation in the equipment test. The MTB Pass'Portes du Soleil has no obligation to explain or instruct on the use of the items of equipment. The Pass'Portes du Soleil MTB istherefore not liable for any damage caused by insufficientexplanations and instructions or by a lack of warning signs. The acquisition of this test card implies, where applicable, adherence to the internal regulations of the event venue and/or organiser. In the event of cancellation or postponement of the event, no reimbursement will be made for your reservation and related costs (transport, accommodation, etc.).
CONTROL
Certain moments and places during the event (Mountain Bike Show, routes, activities, refreshment points, test routes, etc.) may be filmed. By taking a test card, you agree to anyaudiovisual broadcasting of the event on our brochures, websites and social networks (photos, videos). In the event of drunkenness or bad behaviour, the test card may be refused or withdrawn. Never accept a test card from a stranger. In particular, the organiser is not obliged to check the identity of the person presenting the test card on a stand for an equipmenttest. The tester remains responsible for the use made of his or her test card, so in the event of loss or theft, only the personholding the test card will be liable. In the event of a dispute, the French courts shall have sole jurisdiction.

Information and data concerning you are necessary for the management of tests and for our commercial relations. This information and data is also kept for security purposes, to comply with legal and regulatory obligations and to enable us to improve and personalise the services we offer you and the information we send you. In accordance with the regulationson the protection of personal data, you may exercise yourrights (access, rectification, deletion, opposition, limitation and portability where applicable) and determine the fate of your personal data by email. To enable us to respond quickly, please give us your surname, first name, e-mail address and, if possible, your customer reference number. Certain requests to exercise your rights (right of access) must be accompanied by a photocopy of an identity document bearing your signature in order to verify your identity and specify the address to whichthe reply should be sent.
