EMTB EXPERIENCE TOUR– Terms & Conditions

1. Organizer & Scope

The SCOTT EMTB EXPERIENCE TOUR(hereafter "Test Event") is organized by SCOTT Sports SA (hereafter "SCOTT"), with its registered office at Route du Crochet 11, 1762 Givisiez, Switzerland. The Test Event takes place at various locations across Europe and offers SCOTT partners and individuals the opportunity to test SCOTT bikes free of charge during scheduled time slots.

These Terms & Conditions (hereafter "T&Cs") govern participation in the Test Event. By registering, you (hereafter "Participant") agree to be bound by these T&Cs.

2. Eligibility

Participants must be at least 18 years of age. SCOTT reserves the right to request valid proof of age at check-in.

3. Bookings & Check-in

Each bike test ride requires a pre-booked time slot. SCOTT reserves the right to cancel the booking in the event of late arrival. Participants may book for third parties, but each Participant must personally sign the Event Waiver before receiving a SCOTT bike.

4. Participant Responsibilities

Participants agree to:

• Bring and wear their own safety equipment, especially a certified bike helmet.

• Bring their own pedals and cycling shoes if not using standard SPD cleats.

• Follow instructions from SCOTT staff and guides during the Test Event.

• Use the SCOTT bike with due care and return it in the condition it was received.

SCOTT may refuse participation if a Participant lacks mandatory safety equipment or violates these T&Cs.

5. Liability for Damages

Any accident, fall, or damage to the bike must be reported to SCOTT upon return. Participants are liable for any damage resulting from negligent or intentional misuse and agree to reimburse SCOTT for repair or replacement costs as reasonably determined.

6. ID & Deposit

Before receiving a SCOTT bike, Participants may be asked to present a valid government-issued ID for verification. SCOTT may record basic information such as name, document number, and date of birth but will not retain the original or make a copy. A refundable deposit (e.g., credit card hold or cash) may be required.

7. Health, Safety & Insurance

Participants confirm they are physically fit and understand that cycling involves physical exertion and inherent risk of injury or property damage. A helmet must be worn at all times.

Participation is at the Participant’s own risk. By signing the separate Event Waiver, the Participant acknowledges these risks and agrees to release SCOTT and its affiliates from liability, except in cases of gross negligence or willful misconduct. Participants confirm that they are adequately insured against accidents.

8. Consent to the Use of Pictures of Myself

I understand that SCOTT can record my voice take and use pictures (including videos) of myself and/or pictures in which I appear together with other persons during my participation and attendance at the Test Event and may use the images for specified purposes.

SCOTT shall be allowed to use such pictures for marketing, commercial and non-commercial purposes, e.g. on websites, social media channels and in print media on a worldwide level. I am aware that SCOTT may actively publish the pictures in the coming years and that a large number of persons may see the pictures and recognize me in the pictures.

In this respect, I expressly authorize SCOTT to grant third persons to the Event’s partners to use the pictures for advertising and/or commercial purposes.

The permission includes the right to publish the Image on the internet in its original format, edited, or altered in any way that SCOTT deems appropriate. Additionally, I waive any right to royalties or other compensation arising or related to the use of the pictures.

SCOTT shall not be allowed to use the pictures for any purposes that do not relate to SCOTT as a company and/or its products. SCOTT shall also not be allowed to use the pictures in an offensive way.

If you wish to object to such publication, you may make a request to SCOTT by email at: xyz@scott-sports.com, prior to the event and no later than 30 (thirty) days before the event, so that the appropriate measures can be taken.

9. Use of Personal Data

SCOTT will handle all personal data in accordance with applicable data protection laws. Data will be collected for registration, safety, and liability purposes and will not be used for marketing unless explicit consent is provided.

10. Jurisdiction & Governing Law

These T&Cs are governed by Swiss law, excluding conflict-of-law provisions. The exclusive place of jurisdiction is Berne, Switzerland. Mandatory consumer rights under applicable local law remain unaffected.

11. Modifications

SCOTT reserves the right to modify these Terms & Conditions at any time. Updates will be made available at the registration point and on the event website.

Der oben bezeichnete Event wird von der SCOTT Sports SA mit Sitz in Givisiez in der Schweiz organisiert. Dem Teilnehmer ist bekannt, dass die Teilnahme am Event mit physischen Aktivitäten und grosser körperlicher Anstrengung verbunden sein kann. Die Teilnahme am Event kann dazu führen, dass sich der Teilnehmer verletzt. Der Teilnehmer erklärt, dass er sich physisch und psychisch in der Lage fühlt, am Event teilzunehmen. Der Teilnehmer willigt ein, dass die Haftung von SCOTT Sports SA und mit ihr verbundene Unternehmen für allfällige Schäden bzw. Verletzungen, die der Teilnehmer aufgrund seiner Teilnahme am Event erleidet, soweit gesetzlich zulässig, ausgeschlossen ist. Der Teilnehmer bestätigt, dass er über eine Unfallversicherung verfügt. Im Falle einer Regressnahme hat der Teilnehmer die SCOTT Sports SA vor Ansprüchen der Versicherung freizustellen. Streitigkeiten im Zusammenhang mit der Teilnahme am Event unterliegen Schweizer Recht unter Ausschluss aller Normen, die auf ausländisches Recht verweisen. Gerichtsstand ist Bern in der Schweiz.

L'Evénement susmentionné est organisé par SCOTT Sports SA, dont le siège est à Givisiez, en Suisse. Le Participant est conscient que la participation à l'Evénement peut être liée à des activités physiques et à un grand effort physique. La participation à l'Evénement peut entraîner des blessures du Participant. Le Participant déclare qu'il se sent physiquement et mentalement prêt à participer à l'Evénement. Le Participant accepte que la responsabilité de SCOTT Sports SA et de ses sociétés affiliées est exclue, dans la mesure où la loi le permet, pour les dommages respectivement les blessures que pourraient subir le Participant du fait de sa participation à l'Evénement. Le Participant confirme qu’il dispose d’une assurance accident. En cas de recours, le Participant doit indemniser SCOTT Sports contre les réclamations d’assurance. Les litiges relatifs à la participation à l’Evénement sont soumis au droit suisse. Les dispositions faisant référence à une législation étrangère ne sont pas applicables. Le for juridique est à Berne, en Suisse.

The above-mentioned Event is organized by SCOTT Sports SA, incorporated in Givisiez, Switzerland. The Participant is aware that the participation in the Event can be linked to physical activities and great physical exertion. The participation in the Event can lead to injuries of the Participant. The Participant declares that he feels physically and physiologically ready to take part in the Event. The Participant agrees that the liability of SCOTT Sports SA and companies affiliated with SCOTT Sports SA for damages and/or injuries that may occur to the Participant because of his participation in the Event is, as far as legally possible, excluded. The Participant confirms that he/she is insured against accidents. In case of recourse, the Participant has to indemnify and hold harmless SCOTT Sports SA against claims of insurers. Disputes relating to the participation in the Event are subject to Swiss law. Provisions that refer to foreign legislation shall not apply. Berne in Switzerland shall be the place of jurisdiction.
