Being aware that any violation of these regulations may result in Scott Italia s.r.l. refusing to grant the use of the bicycle, by signing and accepting these conditions,

I DECLARE:

that I am not under the influence/effect of any factors that may impair my psychophysical condition during the bike test and that I am in perfect mental and physical health;
that I have reached the age of majority and that I am insured against all risks connected with this bike test, including but not limited to injury, death, damage to third parties and/or property, etc.;
that I am aware of all risks connected with operating the bicycle and that I knowingly assume such risks;
that I will wear all protective equipment deemed appropriate for the purposes of the bike test, using my own safety equipment, in particular a certified bicycle helmet, which must be worn throughout the entire duration of the bike test;
that I will provide a valid identity document in order to verify my identity, and that Scott may record basic information such as my name, document number, and date of birth, without retaining the original document or making any copies. A deposit may also be required, which will be refunded at the end of the bike test provided that all provisions of these regulations have been complied with (e.g. credit card pre-authorization or cash);
that I have verified the bicycle to be in perfect working condition and undertake to report any malfunction and, in such case, to immediately stop using the bicycle until its proper functionality has been restored;
that I undertake not to tamper with any part of the bicycle provided for use;
that I undertake to ride and use the bicycle in accordance with its intended use, in compliance with road traffic regulations, as well as observing the general principles of prudence, diligence, and respect for the rights of others;
that I shall not claim any ownership rights over the bicycle in use;
that I shall not entrust the riding or custody of the bicycle to third parties, under penalty of being held solely responsible;
that I undertake to carefully safeguard the bicycle and not to leave it unattended during any stops;
that I undertake to return the bicycle no later than the time established at booking or at the time of delivery, in the same condition in which it was received, except for normal wear and tear due to use, and I further undertake to compensate for any damage caused to the bicycle or for its commercial value in the event of loss and/or failure to return the bicycle for any reason whatsoever;
that I grant Scott, free of charge, the right to record my voice and use my image (including video recordings) during my participation in the bike test, and that such images may be used for marketing, commercial and non-commercial purposes, for example on websites, social media channels, and printed materials;
that I shall indemnify and hold harmless Scott Italia s.r.l., SCOTT Sports SA and/or its affiliates and holding companies, employees and/or collaborators, to the fullest extent possible, also on behalf of my heirs and/or successors in title:
A) from any and all obligations to pay me compensation of any kind, including damages, indemnities, reimbursements, etc., in the event of any injury, regardless of its cause, duration, outcome, or consequences, and irrespective of who may be responsible, including Scott Italia s.r.l. and its employees and collaborators;
B) from any claims that may be brought by third parties who have suffered damages attributable to me during the bike test;
that I waive any and all claims against Scott Italia s.r.l., SCOTT Sports SA and/or its affiliates and holding companies, employees and/or collaborators for compensation for damages of any kind arising from or in connection with the bike test;
that I assume full and exclusive responsibility, whether civil or criminal, for any accidents and resulting damages suffered by me or to my property, as well as for any accidents and resulting damages caused by me to third parties, their property, or their successors during the bike test;
that I have carefully read and evaluated the content of this document and have clearly understood the meaning of each individual clause prior to signing it, acknowledging that by signing this document I expressly assume, to the fullest extent possible, any and all responsibility related to or in any way connected with the use of the bicycle provided for the bike test;
that I hereby accept the exclusive application of Italian law to all matters covered by this document and related thereto, as well as the exclusive jurisdiction of the Court of Bergamo for any dispute.

The undersigned expressly declares, pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, that they specifically approve the following clauses: 14 (“Indemnity Clause”), 15 (“Waiver of Damages”), 16 (“Assumption of Liability towards Third Parties”), 18 (“Exclusive Jurisdiction”).
