I ACKNOWLEDGE THAT BINDING INDICATOR SETTING HAS BEEN ADJUSTED TO THE WRITTEN VALUE ABOVE UPON MY, MY PARENT’S, OR MY AGENT’S REQUEST WITHOUT REGARD TO ANY RECOMMEDED/CALCULATED DIN SETTING. LIKEWISE, IF SUCH BINDING IS A NON-RELEASING OR OTHER TYPE BINDING (AS DESCRIBED BELOW) OR DOES NOT HAVE AN ISO DIN INDICATOR SETTING OR ADJUSTMENT, I ACKNOWLEDGE THE SAME WILL NOT HAVE AN INDICATOR SETTING.

All information I have provided for this form is true and correct. I am aware that incorrect information provided by me can lead to an incorrect setting of the bindings and is associated with an increased risk of accident and injury. 

I understand that the sports of skiing (including, but not limited to, alpine and backcountry skiing and mountain touring), snowboarding, skiboarding, snowdecking, snowshoeing and other sports (collectively “RECREATIONAL SNOW SPORTS”) involve inherent and other risks of INJURY and DEATH. I voluntarily agree to expressly assume all risks of injury or death that may result from these RECREATIONAL SNOW SPORTS, or which relate in any way to the participation in the Demo Event (“the Event”). I understand that a helmet designed for RECREATIONAL SNOW SPORTS use, when sized and fitted properly, will help reduce the risk of some types of injuries to the user at slower speeds. I recognize that serious injury or death can result from both low and high-energy impacts, even when a helmet is worn; and a damaged helmet should not be used, as damage may compromise the effectiveness of the helmet. I understand that engaging in RECREATIONAL SNOW SPORTS, in a fatigued condition or under the influence of medication, alcohol or other drugs may increase the risk of accident and injury.

I agree to accept for use AS IS all equipment provided to me during this Event, and I agree to accept full financial responsibility for the care of the equipment while it is in my possession. I further agree to be responsible for the replacement at full retail value of any equipment I receive, but do not return upon request, even if it is lost, stolen, or otherwise damaged. I agree to deposit, as a security, an official photo ID card, driver’s license, credit card, or other form of security or copies thereof, as reasonably requested by PROVIDERS.

I understand that the binding system cannot guarantee the user’s safety. I acknowledge and understand that in skiing and snowboarding with skis or snowboards equipped with release bindings, the binding system will not release at all times or under all circumstances where release may prevent injury or death, nor is it possible to predict every situation in which it will release. I understand that additional risk of injury may result if I use visual indicator settings other than those recommended by PROVIDERS (defined below). I acknowledge and understand that in certain types of RECREATIONAL SNOW SPORTS my equipment may be equipped with non-releasing or other bindings (e.g. Mountain touring/backcountry binding systems) that do not comply with DIN ISO 13992 standard or that do not provide any means of adjusting release values. In snowboarding, cross-country backcountry, telemark, and mountain touring skiing, skiboarding with skis or skiboards equipped with non-release bindings, showshoeing and other sports utilizing equipment with non-release bindings, the binding systems will not ordinarily release during use; these bindings are not designed to release as a result of forces generated during ordinary operation. I understand that there are no actual or implied safety of bindings or guarantee of release. I understand that mountain touring bindings are not to be confused with alpine bindings and understand that these types of binding systems do not have DIN settings. Knowing this, I voluntarily agree and expressly assume all risks of injury or death that may result from using any binding system during the Event, especially any equipment that is not Norm compliant or ISO compliant.  

Knowing this, and in consideration of being permitted to participate in Event, I AGREE TO RELEASE AND HOLD HARMLESS the Location event premises owners and operators, the owners, manufacturers and distributors of equipment including Amer Sports Winter & Outdoor Company and its Salomon, Atomic USA, and Armada divisions and their respective employees, affiliates (including but not limited to, Salomon S.A.S. and Atomic Austria GmbH), agents, officers, directors and their successors in interest (collectively “PROVIDERS”) and their vendors from all liability for injury, death, property loss and damage which results from the equipment user’s participation in the RECREATIONAL SNOW SPORTS for which the equipment is provided, or which is related in any way to the use of this equipment, including all liability that results from the NEGLIGENCE of PROVIDERS, or any other person or cause, or otherwise resulting from or arising out of my participation in the Event. 

I have also been informed and understand that PROVIDERS may be producing photographs, videos, films, audio or other media at the Event and that my name, likeness, image, voice, appearance and/or performance is being recorded and may or may not be made part of PROVIDERS’ production.  

I hereby consent that the photographs, video, film, or audio of me or any reproductions thereof taken by PROVIDERS, or its assigned vendors, may be used by PROVIDERS, or its assigns, without time constraints, for the purpose of illustration, catalog, website, television, promotion, advertising or publication in any manner and in any media now known or later developed. I understand that I will not have any interest or ownership in PROVIDERS’ production and that I will not receive any compensation from PROVIDERS for the use of my name, likeness, image, voice, appearance, and/or performance. The grant of rights herein shall be worldwide and perpetual. 

In addition to the foregoing rights I have granted, I consent to the terms and conditions of the PROVIDERS’ Privacy Policy, be located at https://www.atomic.com/en/privacy-policy  or https://www.salomon.com/en-us/privacy.html, as the case may be. Subject to your consent, PROVIDERS may send you promotional information and offers by email, text messages or other digital messages. Additionally, I understand that PROVIDERS are using the online registration platform provided by (nineteen)² and my data is subject to their separate terms and privacy policy

I understand that I may also be required to consent to the privacy policy of PROVIDER’S assigned vendor who may process and store my information on behalf of PROVIDERS for the purpose of the Event.

I understand and agree that I am releasing not only the entities set forth in the paragraph above, but also the parents, subsidiaries, affiliates, officers, directors, agents, employees and other similarly related parties of those entities. I further agree to defend and indemnify PROVIDERS for any loss or damage, including any that results from claims or lawsuits for personal injury, death, and property loss and damage related in any way to the use of this equipment or my grant of rights herein.

If the equipment user is a minor, the user’s parent or guardian signature is required and that parent or guardian agrees to be bound by the conditions of this Release and to indemnify PROVIDERS for any claim or lawsuit allegedly arising out of the use of the equipment provided or the grant of rights. The parent or guardian agrees to pay PROVIDERS all costs and legal fees expended defending against such claims or lawsuits as well as any sum paid as a result of any judgment or settlement.

This Release is governed by the applicable law of the state or province of the Location. If any provision of this Release is determined to be unenforceable, all other provisions shall be given full force and effect.

I accept full responsibility for its care and I confirm that the binding release/retention setting numbers appearing in the visual indicator windows on the bindings correspond to the setting recorded in this Release.

I HAVE MADE NO MISREPRESENTATIONS ON THIS FORM OR OTHERWISE REGARDING MY WEIGHT, HEIGHT, AGE, AND ABILITY LEVEL.

I have received satisfactory answers to my question regarding the use and the function of this equipment. If at any time I feel the equipment is not functioning properly, I will stop using it and will return it for inspection and for any needed repairs or readjustments. I hereby agree to accept the terms and conditions in this Release. This document constitutes the final and entire agreement between this event sponsor, Amer Sports’ Atomic USA/Salomon/Armada brand divisions, as the case may be, and the undersigned. There are not warranties, express or implied, which extend beyond the description of the equipment listed on this Release, and I accept this equipment “AS IS”. I have carefully read this Release and fully understand the release of liability provisions it contains. I am aware that this is a release of liability and a contract between me, the sponsor of this event, and Amer Sports, and I sign of my own free will.
