DISCLAIMER OF LIABILITY AND TERMS AND CONDITIONS

The International Association of Ski Lift Operators of the Portes du Soleil organizes the Pass'Portes du Soleil MTB and its Mountain Bike Show, an event that offers tests of mountain bikes, electric mountain bikes, trottinettes for the public. Through exhibiting brands, this "event" allows to test material to the general public for 3 days in Les Gets. Tests organized via a village of brands with a wide range of brands allowing a wide choice with tests of MTB, eBike, Electric Trottinette ... to the persons having a valid package and a card of tests worth 5 €. This equipment is only available for testing purposes and should not be considered as a free rental opportunity. The sale of material is prohibited except in exceptional cases. The tester agrees to use the test material no more than one hour. With the (digital) signature of this declaration, the test participant accepts and declares to be in agreement with the points

following:

I. The equipment test will take place under its own responsibility. Namely that the tester disengages the responsibility of the mark in case of fall (except hidden defect), and grants that it is responsible for the equipment in case of theft during the test "biped and effective". He also commits to pay attention to the material and thus not to damage it. A scratch on the material may occur but in the case for example of a veiled wheel, the tester agrees to pay the repairs to the brand. In all cases, it is the tester and the brand who returns from an amicable agreement in case of compensation. When returning the equipment, the brand is entitled to claim compensation if it deems that the product was abused voluntarily.

II. The practice of MTB / Trottinette involves risks for the body, health as well as for one's own life, so it is important to practice in a state of consciousness. The tester agrees to give information related to the settings of the equipment. He must have his own pedals and know how to use the material he borrows.

III. Wearing a helmet reduces the risk of dangerous injuries in the event of a fall and even if it does not protect against all risks (especially against various injuries in the areas of the head, neck or spine), it is strongly advised to wear a helmet during the event.

IV. Participation in an MTB lesson will reduce the risk of injury, so feel free to be supervised if you do not have the level.

V. The equipment (MTB / eBike / TROT ...) has been adapted to the participant's own body and behavior characteristics according to the data that he has transmitted.

VI. The tester agrees to respect the rules of conduct on the tracks.

VII. The tester undertakes to adapt his mode of conduct to his abilities and know-how, and that he will exercise caution.

VIII. He must not drink alcohol or other intoxicating substances or take drugs before and during the test. It's common sense, but it's important to remember it. The Pass'Portes du Soleil MTB has no duty of organization and control, especially if the participants possess the know-how and knowledge mentioned in the point VI.

VI. If the data provided by the participants correspond to point V, the Pass'Portes du Soleil MTB has no responsibility for the good condition and aptitude / adaptability of the equipment made available to the test participant. The participant will have to control by himself the equipment before its use and to check if they present defects. The test participant is aware that the equipment is owned by the various brands present on the Pass'Portes du Soleil MTB, that he must handle them with care and return them later in good condition and without any damage. The test participant must compensate the brand concerned for any damage present on the equipment returned. In the case of total destruction, loss, theft, etc. equipment, the test participant agrees to pay compensation up to the replacement market value. Conscious of these circumstances, the test participant waives before the said brand, the Pass'Portes du Soleil MTB and its collaborators, representatives, organizations or other authorized agents to any claim or requirement of any kind, especially those concerning a right of compensation which would derive from participation in the equipment test.

Therefore, the Pass'Portes du Soleil MTB is not liable for damages due to insufficient explanations and instructions or for lack of warning signals. The acquisition of this test card entails, where applicable, adherence to the rules of procedure of the venue of the event and / or the organizer. In case of cancellation or postponement of the event, no refund will be made of your reservation and ancillary costs (transport, hotels, etc.).

CONTROL

Some moments & places of the event (MTB show, routes, animations, supplies, test tracks ...), can be filmed. By taking a test card, you accept a possible audiovisual broadcast of the event on our brochures, websites and social networks (photos, videos). In case of intoxication or bad behavior, the test card may be refused or withdrawn. Never accept a test card that is offered to you by a stranger. The organizer is not required to conduct a verification of the identity of the person presenting the test card on a stand for a test of equipment. The tester remains responsible for the use that is made of his test card, so in case of loss, theft, only the person holding the test card will be responsible. In case of dispute, the French courts are only competent.

The information and data concerning you are necessary for the management of the tests and our commercial relations. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to enable us to improve and personalize the services we offer and the information we send you. In accordance with the regulations on the protection of personal data, you can exercise your rights (access, rectification, deletion, opposition, limitation and portability if necessary) and define the fate of your personal data by email. In order to allow us to answer quickly, we thank you to indicate us your name, first name, e-mail, address and if possible your customer reference. Some requests to exercise your rights (right of access) must be accompanied by a photocopy of an identity document bearing your signature to verify your identity and specify the address to
